Terms and Conditions

Welcome to Hollowmew. Please read these Terms and Conditions (the "Terms") carefully before using the game or the websites. They govern your relationship with the Hollowmew development team ("the Hollowmew team", "we", "us") in respect of the Hollowmew video game (the "App" or the "Game") and the hollowmew.com and beta.hollowmew.com websites (the "Sites"), together the "Service".


1. Subject matter and acceptance

These Terms govern access to and use of the Service, a free wave-survival roguelite video game in a testing phase (closed beta), for mobile devices (iOS and Android) and the web. By creating an account, signing in or using the Service, you declare that you have read, understood and accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. BETA nature

Important. Hollowmew is offered as a closed beta: a version under development, incomplete and in testing. It may contain bugs, fail, stop working, or lose data and progress without notice. Your use of the Service during the beta is at your own risk.

You expressly agree that, during the beta:

  • Your progress, statistics, unlocks or account may be reset, modified or deleted at any time as part of development (for example, when the data structure changes or the beta closes). We do not guarantee the persistence of any data.
  • Certain features may be added, changed or removed without notice.
  • The Service may experience interruptions, maintenance or downtime more often than a finished product.
  • We may end the beta at any time, in whole or in part.

You are not entitled to any compensation for the loss of progress, data or availability during the beta.

3. Licence to use

Subject to your compliance with these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to download and install the App on devices you own or control, and to use the Service for entertainment and beta-testing purposes. This licence does not transfer to you any ownership of the Game.

Except where the law expressly permits, you may not: (a) copy, distribute, sell, rent or commercially exploit the Game; (b) reverse-engineer, decompile or disassemble the Game; (c) modify, translate or create derivative works; (d) circumvent, disable or interfere with security or authentication measures; (e) use the Game to develop a competing product or service.

4. Accounts and requirements

To use the Service you need an account, created exclusively via "Sign in with Google" or "Sign in with Apple". You are responsible for the security of the provider account you sign in with and for all activity carried out through your Hollowmew account.

By registering, you declare that you:

  • Are 14 or older (see Privacy Policy). The Service is not directed to children under 14.
  • Provide truthful information that belongs to you.
  • Are not suspended or barred from using the Service.

Each person must use a single account and not share it. You may delete your account at any time from the Game settings or by writing to us.

5. Acceptable conduct

When using the Service, you agree not to:

  • Cheat, use bots, exploits, unauthorized third-party software or any technique to gain unfair advantages or alter how the Game works.
  • Interfere with, overload or damage our servers, infrastructure or the experience of other users (including attacks, mass scraping or unauthorized access).
  • Use the Service for unlawful, fraudulent purposes or in a way that infringes third-party rights.
  • Impersonate other people or the Hollowmew team.
  • Extract, copy or redistribute the Game's content, art assets or code.

6. Beta feedback

As a beta participant, you may send us comments, suggestions, bug reports or ideas ("Feedback"). Feedback is voluntary. By sending it, you grant us a free, perpetual and irrevocable right to use it to improve the Service with no obligation to compensate or credit you, unless the law provides otherwise. Do not send us confidential information or anything you would not want us to use freely.

7. Intellectual property

The Game and all of its content — including, without limitation, the name "Hollowmew", the realm of "Hollowfell", the characters, cats, enemies, art, sprites, music and sound effects, code, text, lore, logos and design — are owned by the Hollowmew team or its licensors, and are protected by applicable intellectual and industrial property law. All rights not expressly granted are reserved.

"Google" and "Apple" and their respective marks are trademarks of their owners; they are mentioned for identification only. Such mention does not imply affiliation or sponsorship.

8. Service availability

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may suspend, limit or discontinue the Service (in whole or in part) for maintenance, updates, security or the end of the beta, to the extent the law allows.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, continued availability, accuracy or absence of errors. Given its beta nature, we do not warrant that the Service will meet your expectations, or that data or progress will be preserved.

Nothing in these Terms excludes or limits the rights that mandatory consumer-protection law grants you when you act as a consumer.

10. Limitation of liability

To the maximum extent permitted by law, the Hollowmew team shall not be liable for indirect, incidental, special or consequential damages, nor for loss of profit, data or progress arising from the use of or inability to use the Service during the beta. The Service is free and provided for testing: you accept that your use is at your own risk.

This limitation does not apply to damage caused by wilful misconduct or gross negligence, to damage to life, bodily integrity or health, or to any other liability that cannot be excluded or limited by law, in particular towards consumers.

11. Suspension and termination

We may suspend or cancel your access to the Service, temporarily or permanently, if you breach these Terms, if your use endangers the Service or other users, or where required by law. Where reasonable and proportionate, we will try to notify you. We may also close the beta and deactivate the associated accounts.

You may stop using the Service and delete your account at any time. Termination does not affect clauses that by their nature must survive (intellectual property, disclaimer of warranties, limitation of liability and governing law).

12. Apple App Store and Google Play

If you obtain the App through the Apple App Store (or TestFlight) or Google Play, the relevant store's terms also apply to you. You acknowledge that these stores are not party to these Terms and are not responsible for the Game or its support. Apple and Google are third-party beneficiaries of these Terms insofar as they concern your use of the App downloaded from their platform, to the extent required by their developer terms.

13. Changes to the Terms

We may update these Terms to reflect changes to the Service or the law. We will publish the version in force with its "Last updated" date and, if the changes are substantial, notify you by reasonable means. Using the Service after the changes take effect means you accept them.

14. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals determined in accordance with the law. If you act as a consumer, the jurisdiction that mandatory consumer-protection law grants you will prevail (generally that of your domicile). If you do not act as a consumer, the parties submit to the courts and tribunals of the controller's domicile in Spain. You also retain, where applicable, the right to use an EU online dispute-resolution platform.
